UMG previously sued its owner, Escape Media Group, for providing access to the label's pre-1972 songs. The company was also recently sued by a Danish coalition of rights holders and has been the subject of complaints by some artists such as King Crimson. Earlier this year, Google pulled Grooveshark from its Android market because of copyright concerns, and the company, based in Florida, only has a deal with one major record label, EMI. Nevertheless, the company has been growing fast, reporting more than 30 million unique visitors per month and a recent revamp that looked to build further bridges into social media. It has also scored some premium advertisers, such as Mercedes-Benz. UMG's latest lawsuit reportedly goes further than most copyright complaints by alleging specific action by the company's top executives. For instance,Grooveshark's CEOSamuel Tarantino is accused of having uploaded at least 1,791 copyrighted songs. UMG's complaint also makes issue of the ineffectiveness of takedown notices in getting the service to remove copyrighted material, which could be a disqualifier if Grooveshark seeks safe harbor from copyright liability under the DMCA. RATINGS RAT RACE: CBS Series & NBCs Rock Center Rise, Fox Dramas Slide
CBS’ Monday lineup posted across-the-board gains for a second straight week. How I Met Your Mother (4.5/12 in adults 18-49, 10.4 million total viewers) was up a tenth in 18-49 from last Monday, 2 Broke Girls (4.8/12, 11.7 million) was up 7% from its fast national last week to post its best 18-49 rating in the 8:30 PM slot, Two And A Half Men (5.3/12, 14.6 million) was up 4% to once again rank as the top program of the night in 18-49, and Mike & Molly (4.4/10, 12.2 million) was up 5%. Hawaii Five-0 (3.3/8, 11.5 million) flourished without scripted broadcast competition in the 10 PM hour, up 10% in the demo from its fast national last week to post its best demo and total viewer number since the season premiere. Hawaii will likely tie its season-high opener in the finals if it’s adjusted up a tenth as it normally is. CBS (4.2/10, 12 million) easily won the night in 18-49. NBC’s Rock Center With Brian Williams (1.3/3, 4.5 million) last night boasted the biggest news “get” of the moment, an exclusive interview with former Penn State football coach and accused child molester Jerry Sandusky. The one-on-one with Bob Costas boosted the struggling newsmagazine to its highest rating to date, up 30% from the 1.0 Rock Center posted in its first two weeks. Still, the show was dwarfed in the 10 PM hour by another newsmagazine, ABC’s special edition of 20/20 (2.8/7, 13.4 million) featuring Diane Sawyer’s interview with recovering shooting victim U.S. Rep. Gabrielle Giffords, as well as CBS’ Hawaii Five-0. Rock Center also ranked as the lowest-rated program on the Big 4 networks, and its fast national numbers may have been inflated by a local NFL pre-emption in Minneapolis, so an adjustment down is a strong possibility. Ditto for NBC’s The Sing-Off (1.5/4, 4.7 million). ABC’s Dancing With The Stars (3.4/8, 18.5 million) was up a tenth in the demo from last week’s fast national, while 20/20 posted ABC’s best ratings for a newsmagazine since Sawyer’s interview with another survivor, Jaycee Dugard, in July. Terra Nova (2.3/6) was down 12%, while House (2.5/6) was down 7% from its fast national. The declines were disproportionally bigger on the male side, which is a bit puzzling because Monday Night Football on ESPN (9.2 metered market average) was also down, by 21%, from last week. The CW’s Monday dramas held steady.

Conservatives Monday, though, simply used the circumstances around those hires as further proof of leftwing bias in the mainstream media. NewsBusters, a right-leaning watchdog group, for example, contrasted the NY Times' handling of NBC's Clinton hire with the way it portrayed NBC's hiring of Bush Hager. The Times, which broke the Clinton story, quoted NBC News president Steve Capus gushing over the daughter of President Bill Clinton and Secretary of State Hillary Clinton in a lengthy Sunday article. Bernanke could do your reports on the Fed, Clinton will do your reports on the Republicans," Beck joked. "They did hire Meghan McCain, and she just trashes Republicans," one of Beck's sidekicks said. 'Nothing To Declare'While Hollywood tentpoles dominated the French box office once again in 2011, it was a good year for mainstream Gallic comedies, high-profile American indies and a handful of arthouse sleepers hits.Gaul's top independent distributor, Pathe, scored with Dany Boon's "Nothing to Declare," which topped the B.O. with a $74.5 million gross.Other high-concept local comedies, notably "Back to Square One" and "Service Entrance," were some of of the year's highest-grossing Gallic pics.While Mars Distribution and Wild Bunch hit B.O. gold with "The King's Speech" and "Midnight in Paris," respectively, the two distribs also fared well with local pics, such as Maiwenn's "Polisse" and Valerie Donzelli's "Declaration of War."Jean Labadie's arthouse distrib and sales shingle Le Pacte also clinched strong box office figures with two Cannes standouts: "Drive" (co-distributed with Wild Side Films) and "We Have a Pope"Box office was down 2.2% from Jan. 1 to Sept. 30; and the breakdown of admissions was stable compared with 2010 with French pics repping approximately 33.4% and American pics nabbing a 51.3% market share."The box office potential for indie films is bigger than in other European countries thanks to the big number of theaters (arthouse and multiplexes) and distributors; that explains why the French market is highly competitive -- prices of films tend to get out of control," says Eric Lagesse, co-topper of Distributeurs Independants Reunis Europeens, the network of independent distributors in Europe. "In France, it's not uncommon to see a smaller independent film handled by a big distributor play in multiplexes as well as arthouse theaters."Meanwhile, the French VOD market is heating up: Canal Plus is rolling out its first subscribtion-based VOD platform, CanalPlay Infinity, while Wild Bunch's FilmoTV is boosting its offerings with five new film channels and three times more titles.Distribs across the board agree that VOD revenues have become larger but "they still don't make up for the declining DVD sales," says Jean-Phillipe Tirel, topper of Wild Bunch Distribution.In terms of TV deals, feature debuts and indie pics with no cast are nearly impossible to sell to most free-to-air channels, apart from Franco-German net Arte, says Lagesse. Even paybox Canal Plus, a big backer of French cinema, has become more selective over the past three years.
